Driving on a Suspended License

Oregon Traffic Violation – License Suspension

Generally, driving on a suspended license is a Class A traffic violation that carries a $600 fine. This may be a short term license suspension as a result of civil penalties, too many traffic violations, a few speeding tickets, etc.

There are many situations, however, that elevate that charge to a more serious offense.

Criminal Driving on a Suspended License – Oregon Laws

If you are caught driving on a suspended license and your license was originally suspended for one of the reasons below, you will face a much more serious criminal offense:

  • Refusal to take a breath test after a suspected DUI stop and arrest
  • Reckless endangerment, criminal mischief, or menacing involving a vehicle
  • Perjury of false statements given to the DOT
  • Positive breathalyzer resulting in a blood alcohol content greater than .08% (DWI) (a breath test failure)
  • Fleeing or attempting to elude an officer
  • Conviction of habitual offender status
  • Reckless driving

If your license was initially suspended for any of these reasons, you driving on a suspended license charge will be classified as a Class A misdemeanor which is punishable by up to 1 year in jail and fines reaching $6250. Your suspension can also be extended.
